(1) Financial Regulatory Reform-H.R. 4173
Over the Chamber's strong objection, the House passed H.R. 4173, the Wall Street Reform and Consumer Protection Act of 2009, on December 11 by a vote of 223-202.


The Chamber has long advocated for overhaul of the nation's financial system. Unfortunately, H.R. 4173 failed to achieve the meaningful financial regulatory reform necessary for vibrant capital markets and to fuel long-term economic growth and job creation. Many provisions, especially the creation of a Consumer Financial Protection Agency, would only magnify and exacerbate flaws within the existing regulatory structure and hamper the growth of the economy.


The Senate may take up similar legislation to reform the financial regulatory system in 2010.

(2) Consumer Protection Council Amendment-H.R. 4173
On December 11, the House narrowly defeated the Minnick Amendment to H.R. 4173, the Wall Street Reform and Consumer Protection Act of 2009, by a vote of 208-223. The Chamber supports strong consumer protection and supported the Minnick Amendment because it would establish a Consumer Financial Protection Council whose membership would be composed of existing regulators and agencies.


Such a council would be a significant improvement over the stand-alone agency in the base bill that added another regulatory layer to a broken regulatory system, unwisely separated safety and soundness regulation from consumer protection, and significantly curtailed the availability and affordability of credit for consumers and small businesses.

 

(3) Mortgage Modification Amendment-H.R. 4173
On December 10, by a vote of 188-241, the House rejected the Marshall Amendment to H.R. 4173, the Wall Street Reform and Consumer Protection Act of 2009. The Chamber opposed this amendment because it would have granted new powers to bankruptcy judges to modify the terms of existing legitimate mortgage contracts, which constitutes an improper expansion of the bankruptcy code.


While the Chamber believes that Congress should take meaningful steps to prevent mortgage foreclosure and correct the volatile housing market, this amendment would have injected greater risk into the lending process that would have led to increased mortgage costs for primary residences in the form of higher interest rates, down payments, points, and fees.

(4) Small Business Derivatives Amendment-H.R. 4173
On December 10, the House passed the Murphy Amendment to H.R. 4173, the Wall Street Reform and Consumer Protection Act of 2009, by a vote of 304-124. The Chamber supported the Murphy amendment because it would impose effective and appropriate regulations on derivatives swaps without unnecessarily impacting business end users.


By limiting entities covered by the bill to those with derivatives positions large enough to significantly impact the financial system, the amendment would ensure that business owners who do not pose a systemic risk are not subject to onerous regulatory requirements, including mandatory central clearing, exchange trading, and margin and capital requirements.
 

(5) Troubled Asset Relief Program (TARP) Accountability-H.R. 1242
On December 2, the House passed H.R. 1242, the TARP Accountability and Disclosure Act, 421-0. This legislation would require the use of existing technologies to create a single publicly available base to track TARP expenditures in near real time.


The Chamber strongly supported TARP as a means of stabilizing the collapsing financial system and of creating special conditions for recovery. Accountability related to TARP, however, is an important priority. This legislation would create transparency to help ensure that funds are appropriately expended and that a high level of public confidence is restored to the program.


The Senate was unable to act on H.R. 1242 before adjourning in 2009. The Chamber will continue to work with leaders in the Senate toward enacting this legislation to increase accountability and transparency.
 

(6) Health Care Reform-H.R. 3962
On November 7, the House passed H.R. 3962, the Affordable Healthcare for America Act by a narrow vote of 220-215. While the Chamber supports meaningful health care reform, we opposed this legislation because it would take the wrong approach in addressing the core issues in the health care debate, in particular coverage, access, quality, and cost.


H.R. 3962 would make health care more expensive, create onerous new burdens for businesses, establish a public option to compete with the private insurance market, increase government spending in the health sector, and implement a variety of new taxes. As a consequence, this bill would only make the status quo worse at a considerable price tag to the business community and the taxpayers.


The Senate took no action on H.R. 3962. Instead, H.R. 3590 was passed through both Chambers and signed into law by the president in March 2010.
 

(7) Homeland Security-H.R. 2868
On November 6, the House passed H.R. 2868, the Chemical and Water Security Act of 2009 by a 230-193 vote. The Chamber opposed this legislation because it would authorize the Department of Homeland Security to require chemical facilities to undertake burdensome and costly new technology upgrades and would undercut the central strength of the Chemical Facility Anti-Terrorism Standards program already in place.


The Chamber looks forward to working with Congress to improve safety at facilities that store and distribute chemicals in a manner that is not overly burdensome and costly.

(8) Solar Technology Promotion-H.R. 3585
On October 22, the House passed H.R. 3585, the Solar Technology Roadmap Act by a 310-106 vote. The Chamber supported this legislation because it would provide additional federal funding to advance U.S. research, development, and demonstration efforts related to solar technology, which would help provide a competitive and growing marketplace for this important alternative energy source.


The Chamber also supported the bill's emphasis on the importance of collaboration between the federal government and American industry.


The Chamber looks forward to working with Congress to enact legislation that promotes alternative energy and collaboration between government and the business community.

(9) Travel Promotion Act of 2009-H.R. 1035
On October 7, the House passed H.R. 1035, the Travel Promotion Act by a vote of 358-66. This legislation would create a public-private partnership to promote the United States as a travel destination abroad.


The Chamber supports this bill because international travelers provide a critical boost to businesses, as well as to state and local economies. The partnership that would be established by the Travel Promotion Act has the potential to attract 1.6 million new international visitors annually and would do so without requiring any funding from American taxpayers.


The Travel Promotion Act was passed into law by President Obama in March 2010.

(10) Advanced Vehicle Technology-H.R. 3246
By a 312-114 vote, on September 16, the House passed H.R. 3246, the Advanced Vehicle Technology Act. The Chamber supported this legislation because it would promote important research and development investment in technologies to improve vehicle efficiency and reduce emissions while helping support jobs.


The legislation would establish a program within the Department of Energy to commercialize a range of technologies necessary to make cars and trucks more energy efficient-a critical step that would help automobile companies adapt to a changing marketplace.


The Senate took no action on H.R. 3246 in 2009. Moving forward, however, the Chamber will continue to work with Congress on this legislation and other efforts to improve automobile efficiency and create jobs.

(11) Energy Regulation and Taxes-H.R. 2454
On June 26, by a vote of 219-212, the House narrowly passed H.R. 2454, the American Clean Energy and Security Act, despite the Chamber's strong opposition.


The Chamber believes that we need to develop a comprehensive plan to address climate change; however, the approach taken by this legislation would have a devastating impact on the U.S. economy while failing to reduce global emissions. Specifically, this bill would not ensure that cost-effective and reliable renewable and alternative energy sources - including nuclear, coal, and other emerging energy technologies - are developed and deployed to smooth a transition to a low-carbon energy future. Instead, H.R. 2454 would create onerous new burdens and regulations on the American public and businesses.

The Chamber believes that Congress should balance environmental objectives with the need for economic growth and job creation, promote technology development, reduce barriers for climate-friendly energy sources, promote energy efficiency, and implement appropriate steps to deal with international global emissions.


The Chamber remains committed to working with Congress to craft legislation to improve environmental quality without harming our economy and businesses.
 

(12) 2010 Budget Resolution-S. Con. Res. 13
Despite the Chamber's strong opposition, on April 29 the House approved the conference report on S. Con. Res. 13 by a 233-193 vote. The blueprint laid out by Congress in this budget resolution created an enormous expansion of the federal government, paid for in large part by increasing taxes on businesses and upper income individuals. The resolution also authorized Congress to use the budget reconciliation process to make dramatic changes to our nation's health care and education systems, which will impact the business community.


The Chamber strongly opposes any congressional efforts to increase taxes on small businesses, because it hinders their ability to create jobs and help get the economy back on track.


Further, the Chamber opposes use of reconciliation to make sweeping policy changes in areas such as health care and education. These issues are critical to the business community, and policy changes must receive thorough consideration through the normal legislative process.

 

(13) Restrictions on Executive Compensation-H.R. 1664
On April 1, by a vote of 247-171, the House passed H.R. 1664, which would place restrictions on compensation for executives at companies that had participated in certain government assistance programs. The Chamber opposed this legislation because it would create unintended consequences that could hamper efforts to resolve the ongoing financial crisis and restore economic growth.


Further, the Chamber was concerned that such changes would create disincentives for private enterprise to participate in an announced public-private investment program; foster uncertainty in business dealings, thereby eroding confidence and slowing economic activity; and limit companies from retaining necessary talent.


While the Chamber appreciates the serious and understandable public concern about executive pay, it believes that compensation should be based on the balance of individual accomplishment, corporate performance, adherence to risk management, compliance with laws and regulations, and shareholder value.
 

(14) Economic Stimulus-H.R. 1
On February 13, the House passed the conference report to H.R. 1, the American Recovery and Reinvestment Act of 2009 by a 246-183 vote. The Chamber supported H.R. 1 because this legislation was critical to help get the U.S. economy back on track.


The tax relief and spending provisions in the bill provided important assistance to sectors of the economy that had been hurt by the financial crisis and helped prevent further loss of American jobs.


The Senate subsequently passed the conference report, and the president signed it into law on February 17.


(15) Paycheck Litigation Expansion-H.R. 12
On January 9, by a vote of 256-163, the House agreed to H.R. 12, the Paycheck Fairness Act. While the Chamber supports equal employment opportunities for all Americans, it opposed H.R. 12 because it would expand remedies under the Equal Pay Act to include unlimited punitive and compensatory damages, significantly erode employer defenses for legitimate pay disparities, and impose invalid tools for enforcement by the Department of Labor.


Following House passage, the Senate did not take any action on H.R. 12 in 2009.
