Letter Applauding the Introduction of S. 3333, the “Data Security and Breach Notification Act of 2012”

Dear Senator Toomey:

The U.S. Chamber of Commerce, the world’s largest business federation representing the interests of more than three million businesses and organizations of every size, sector and region, applauds the introduction S. 3333, the “Data Security and Breach Notification Act of 2012.”

The protection of consumers’ sensitive personal information is one of the top priorities of the business community. However, there are currently 46 states with their own data breach and notification laws, requiring companies to comply with a difficult and confusing patchwork of laws. S.3333 would address this issue by creating a single regime within the FTC for data security enforcement, preventing private rights of action, and preempting state laws. We believe this to be the best approach among the various “data security” bills being offered in the Senate as it would provide U.S. businesses with a consistent and predictable national framework for data security and breach notification.
