Association Health Plans

On March 28, 2019, the U.S. District Court for the District of Columbia struck down the provisions of the Department of Labor’s final rule that (1) expanded the range of associations that may offer AHPs and (2) expanded the range of who may participate in AHPs to include sole proprietors.  This decision may have significant consequences for AHPs established in reliance on the Department of Labor’s final rule.
