District court denies government’s motion to dismiss case challenging agency decision to disclose documents under the Freedom of Information Act (FOIA)

September 29, 2023

The court held that the complaint adequately alleged (1) that disclosure would violate the Trade Secrets Act and (2) that company modeling data were commercial under FOIA Exemption 4.  The U.S. Chamber filed an amicus brief supporting this outcome.
