NCLC filed an amicus brief urging the Eleventh Circuit to hold that a ban on class arbitration waivers based on state law would violate the Federal Arbitration Act. Such a ban would prompt businesses to abandon arbitration agreements to the detriment of consumers, who Congress and the courts have regularly said benefit from individual arbitration of disputes.
