U.S. Chamber files amicus brief urging court of appeals to vacate labeling mandate requiring businesses to affix an image of a chemical flask labeled “PFAS” to products containing per- and poly-fluoroalkyl substances

The brief explains that the mandate is not “purely factual and uncontroversial,” is subject to strict scrutiny under the First Amendment, and cannot satisfy even the more deferential Zauderer standard.
The Chamber previously filed an amicus brief supporting the plaintiffs in a federal district-court case challenging the same mandate.
