Federal district court issues preliminary injunction on First Amendment grounds against state law that mandates warning label for food products that purports to represent the views of regulators in four foreign jurisdictions

February 11, 2026

Relying in part on the Chamber’s coalition amicus brief, the court’s opinion concludes that the mandated warning is not subject to the deferential Zauderer standard.

U.S. Chamber files coalition amicus brief urging district court to enjoin unusual warning-label mandate for food products with certain ingredients, which purports to represent the views of regulators in four foreign jurisdictions

December 19, 2025

The Chamber's coalition amicus brief explains how the mandated warning is not “purely factual and uncontroversial,” is subject to heightened First Amendment scrutiny, and fails to satisfy even the more deferential Zauderer standard (assuming arguendo that Zauderer applies to the warning).

Brandt Leibe, Jeffrey S. Bucholtz, Michael L. Resch, and Dale J. Giali of King & Spalding LLP served as outside counsel.
