U.S. Chamber files amicus brief urging court of appeals to affirm preliminary injunction against warning-label mandate for food products that purports to represent the views of regulators in four foreign jurisdictions
August 10, 2026
The Chamber's amicus brief explains how the mandate is not “purely factual and uncontroversial,” is subject to strict scrutiny under the First Amendment, and cannot satisfy even the more deferential Zauderer standard.
Jeffrey S. Bucholtz and Matthew V.H. Noller of King & Spalding LLP served as outside counsel.
The Chamber previously filed a coalition amicus brief when this case was before the district court.
