White House Submits Emanuel for NLRB

President Trump on June 27 announced his intent to nominate William Emanuel of the law firm Littler Mendelson to serve as a member of the National Labor Relations Board (NLRB).  If confirmed, it would make him the third Republican on the five-seat Board and create a Republican majority for the first time in nearly a decade.  President Trump recently nominated Marvin Kaplan of the Occupational Safety and Health Review Commission for another vacant Republican seat on June 19.

As this blog has written repeatedly, the NLRB currently has a 2-1 Democrat majority, so until the U.S. Senate confirms Emanuel and Kaplan, Republican Chairman Phil Miscimarra can still be outvoted in NLRB decisions, which has happened in numerous instances.  Given the amount of uncertainty caused by the NLRB during the previous administration, the business community will welcome a restoration of balance on the Board.  

Hopefully, the Senate will act swiftly on these nominations to restore common sense to the NLRB.
