WASHINGTON, D.C. — Daryl Joseffer, Executive Vice President and Chief Counsel at the U.S. Chamber Litigation Center, issued the following statement reacting to the Eighth Circuit’s decision today in Minnesota Telecom Alliance v. Federal Communications Commission.

“The U.S. Chamber of Commerce applauds today’s decision reinforcing a simple principle: regulators must stay within the authority Congress provides.

“The Chamber challenged this Biden-era regulation because it was overly broad, covering nearly every business practice related to providing access to broadband. This includes pricing, credit checks, and marketing campaigns—and exerting authority over any business or local government involved in facilitating that access.

“For underserved communities and small businesses, being connected to education, family, healthcare, and other opportunities is essential to participating in the 21st-century digital economy. Today’s decision should allow the FCC to return to its core focus on expanding connectivity, not expanding its powers beyond what Congress intended.

“The Chamber is especially appreciative to FCC Chairman Carr for his longstanding opposition to this illegal and misguided rule.

“The Chamber advocates for an environment where American businesses can invest and grow with confidence. Clear, lawful regulatory frameworks are essential to expanding affordable, reliable broadband, strengthening communities and supporting economic growth nationwide.”
