The undersigned organizations strongly support H.R. 2675, the “Protecting Our Courts from Foreign Manipulation Act of 2025.” This critical legislation is a necessary step to safeguard the integrity of the U.S. legal system and protect national security by addressing the growing risks posed by foreign-sourced third-party litigation funding (TPLF).
TPLF, a rapidly expanding multi-billion-dollar industry, allows foreign entities, including sovereign wealth funds and foreign states, to secretly invest in U.S. litigation. The lack of transparency surrounding its use has created significant vulnerabilities in our legal system. Foreign entities and adversaries can exploit these vulnerabilities to advance their strategic, economic, or political interests, often at the expense of U.S. companies, industries, and national security.
H.R. 2675 takes a comprehensive approach to addressing these risks by requiring robust disclosure and imposing critical limitations on foreign-sourced TPLF. Specifically, the bill mandates that parties disclose the identity of any foreign person, foreign state, or sovereign wealth fund that has a contingent financial interest in the outcome of a civil action. It also requires the production of relevant funding agreements for inspection by the court, other parties, and the Department of Justice. Importantly, the legislation also prohibits third-party litigation funding by foreign states and sovereign wealth funds, ensuring that foreign governments cannot use TPLF as a tool to undermine U.S. interests.
This secrecy surrounding TPLF creates opportunities for foreign entities to weaponize the U.S. legal system, whether by targeting critical industries, accessing sensitive information through discovery, or driving up litigation costs to harm American businesses. The lack of transparency in foreign-sourced TPLF also allows funders to exert undue influence over litigation strategies and settlements, often prioritizing their financial or strategic objectives over the best interests of plaintiffs and the integrity of the judicial process.
H.R. 2675 is a vital step toward closing these dangerous loopholes. By requiring transparency and prohibiting foreign states and sovereign wealth funds from investing in U.S. litigation, this legislation will help ensure that our courts remain a forum for justice, not a battleground for hidden foreign agendas.
