Dear Majority Leader Thune and Minority Leader Schumer:

We, the undersigned associations, representing businesses of all sizes and sectors strongly support the proposed 10-year moratorium on enforcement of state and local AI-specific regulations. 

More than 1,000 AI-related bills have already been introduced at the state and local level this year. Without a federal moratorium there will be a growing patchwork of state and local laws that will significantly limit AI development and deployment. Even states that forgo new regulations will see AI products and services in their state limited as companies seek to provide a national product that complies with the regulations enacted by other states.

A moratorium, like the one proposed, would allow time for Congress to consider and, as necessary, adopt tailored regulations that address specific issues that arise with respect to AI development and use. Such provisions would have the benefit of being national in scope ensuring uniform application across the country.

Artificial intelligence is poised to contribute $15.7 trillion to the global economy by 2030[1] and will be one of the primary drivers for revenue and hiring growth for businesses throughout the United States. A 2024 study highlighted that “ninety-one percent of small and medium businesses (SMBs) utilizing Artificial Intelligence say that AI will boost their revenue[2]. This increase in productivity and growth will only be possible if businesses and companies have the regulatory clarity that provides a predictable and consistent national standard.  

A patchwork of state and local regulations will hit hardest on small businesses who do not have the resources to successfully navigate various and conflicting state and local rules. In fact, a recent U.S. Chamber report highlighted that 25% of small business owners are already not utilizing AI tools because they are “concerned about legal or compliance issues[3].” The same report highlighted that a majority of small businesses are worried that having to comply with different state laws in which they are not headquartered will expose them to higher compliance and litigation costs[4]

The development of AI is evolving rapidly, and along with it, opportunities to revolutionize industry, attract new investment, and create high-paying jobs within our communities. For this reason, we strongly support Congress' effort to implement a 10-year moratorium on state and local rules governing artificial intelligence.
