TO THE MEMBERS OF THE UNITED STATES SENATE:
The U.S. Chamber of Commerce strongly opposes S.J. Res. 52, which would undo the Federal Communications Commission’s “Restoring Internet Freedom” order, and bring about the return of Depression-era public utility-style treatment of the internet inconsistent with the modern global economy. The Chamber will consider including votes on, or in relation to, this legislation in our annual How They Voted scorecard.
The Chamber supports net neutrality. However, Congress should play the lead role in determining how best to maintain a free and open internet. Congress should engage in a deliberative, regular order, and committee-driven process to incorporate net neutrality principles into law that would ensure consumers are able to access any and all lawful content. Any such legislation should reject the approach in FCC’s 2014 order that regulated broadband under the archaic 1934 Title II “common carrier” framework.
