U.S. Chamber files amicus brief

The U.S. Chamber filed an amicus brief urging the Ninth Circuit to reaffirm that under California law, a manufacturer of a product has no duty to disclose defects in the product beyond the duration set forth in its express warranty, absent either an affirmative misrepresentation or an unreasonable safety defect. Theane Evangelis, Bradley J. Hamburger, Daniel R. Adler, Matt Aidan Getz, and Lana El-Farra of Gibson, Dunn & Crutcher LLP and the U.S. Chamber’s Litigation Center served as co-counsel for the U.S. Chamber.
