U.S. Chamber files amicus letter urging review of bypass standing requirement case

NCLC urged the California Supreme Court to grant review to consider whether a plaintiff with no standing pursuant to Proposition 64 may conduct discovery to find an appropriate plaintiff. NCLC argued that the appellate court’s decision creates an “end-around” Proposition 64, eroding the standing requirement, which California voters demanded, by simply replacing phantom plaintiffs for strawman plaintiffs. NCLC warned that the appellate court has opened the flood gates to litigation regardless of actual injury and will cause businesses to spend millions defending frivolous actions.
