U.S. Chamber files amicus letter rejecting the duty to warn of harm from third party products

April 15, 2009

NCLC urged the California Supreme Court to deny a petition to review a decision by a California appeals court correctly holding that manufacturers of nonhazardous component parts could not be held liable for failing to warn about asbestos added to its product post-sale. In its amicus letter, NCLC argued that the appeals court’s ruling correctly rejected a radical expansion of asbestos liability against manufacturers whose products contained no asbestos.
