The Honorable Charles S. Trump IV

Chairman

Judiciary Committee

West Virginia Senate
Charleston, WV 25305

Dear Chairman Trump:

The U.S. Chamber of Commerce supports Senate Bill 528, the “Uniform Worker Classification Act.” The Act would clarify West Virginia law so that workers and employers understand when an individual is, or is not, working as an independent contractor. Critically, the Act would provide a uniform definition across multiple West Virginia statutes so that a worker would no longer potentially be considered an employee under one law, but not another.

Providing clarity has become critical with the rise of new technology and new ways for individuals to earn income. By establishing a clear, yet flexible standard, West Virginia can be a leader and provide a legal structure that benefits workers, businesses, and consumers.

The U.S. Chamber of Commerce thanks you and the Committee for your leadership on this issue, and we urge the passage of SB 528.

Sincerely:

Glenn Spencer
