The U.S. Chamber on March 7, 2022, submitted comments to the National Labor Relations Board (NLRB) in the case Stericycle, Inc. 371 NLRB No. 48 (2021) in response to the NLRB's invitation for briefs addressing whether the Board should adopt a new legal standard to determine whether employer work rules violate Section 8(a)(1) of the National Labor Relations Act.

In its comments, the Chamber argues that the Board should maintain its current employer work rules standards under The Boeing Co., 365 NLRB No. 154 (Dec. 14, 2017), and its progeny. These standards have provided a predictable and administrable framework for employers to maintain reasonable work rules and fulfill their duty to respect employee rights.
